Camp Hill residents can keep their temporary political yard signs posted for as long as they like during the election period.
An ordinance passed by the Camp Hill Borough Council in October 2022 states that residents can only post two political signs in their yards within 60 days of an election. Violations of this ordinance will result in a $1,000 fine.
A federal judge ruled against the sign ordinance in March 2023 after a group of residents petitioned the court, arguing that the ordinance restricts freedom of expression.
The City Council argued that the sign ordinance “is intended to protect the beauty of our community and enhance public safety by reducing clutter, distraction, and hazards.”
However, Judge Jennifer Wilson of the Middle District Court of Pennsylvania granted summary judgment on two counts against the two plaintiffs.
On May 9, the Third Circuit Court of Appeals affirmed the district court’s decision.
“The Borough is disappointed in the Third Circuit’s decision, which could have far-reaching implications for the Borough and other municipalities’ ability to meaningfully regulate signage in pursuit of traffic safety and aesthetics,” the Borough Council said in a statement.
