Waikal was elected to the National Assembly after defeating Kirtikar by 48 votes.
The petition, filed through lawyer Amit A Karande, claims that Waikal’s election is invalid as the result was significantly affected due to irregular vote receipts, leaving 333 votes uncounted.
The plea further alleges that the Election Officer (RO) completely violated statutory rules and orders during the vote counting process.

The counting agents appointed by Kirtikar were not allowed to sit at the RO table despite having the statutory right to do so.

Form 17-C (Part II) (Counting Result) was not distributed in 839 polling stations.

Kirtikar’s application for a recount of votes was quickly rejected.

Unauthorized use of a mobile phone occurred within the counting area.

There was voter impersonation.

Discrepancies were noted in the number of bids recorded.
The petition therefore seeks that Waikal’s election be set aside and Kirtikar be declared the winning candidate.
